Estates

VALUATION OF…

Estates

Deceased or insolvent estate property, valued at Market Value for estate administration, distribution, or Master’s Office purposes.

Content status: Methodology and evidence log — Sources, Caselaw and Market Information are added incrementally.

Methodology

Property held in a deceased or insolvent estate is valued at Market Value using the approach appropriate to the specific property type, for purposes of estate administration, liquidation and distribution, or Master’s Office reporting — the estate context does not itself change the valuation method, though the required reporting date (typically date of death or sequestration) must be clearly identified.

The Big Five framework is applied to the underlying property in the normal manner appropriate to its type; the distinguishing feature of estate valuations is the effective date, which may be materially earlier than the report date, requiring the valuer to have regard to market conditions prevailing at that historical date rather than at the date of inspection.

Where the effective date is retrospective, the Direct Comparison or income evidence used should be drawn from transactions around that date, with any necessary index-based adjustment to bring later or earlier evidence to the required date clearly disclosed.

Caselaw

Case law, regulatory rulings and expert-determination disputes relevant to valuing this asset class. Each entry cites its source and summarises the practice implication for valuers — this is not investment, financial, or legal advice.

The Evidence Log is for VDH Members
